Purpose of the page

MESEON is a platform devoted to extend, in general, the culture and specifically the plastic arts. Thus, MESEON is formed on the one hand, like a platform in which all lovers of the general art can share their requests and knowledge, that is, a social network offering the possibility to all Internet Users, interested in the fine arts, to make comments, vote and express opinions in forum not being necessary to buy or sell art; On the other hand, in a platform for a worldwide projection, offered in Internet of the plastic works of all those ARTISTS that wish to extend their Works in this way, whoever be the creator of a plastic work can use MESEON to promote and show their creations thus making easier their eventual sales.

MESEON makes reference to the term “artist” in their widest creative sense, understanding as such every creator of any original piece of art.

So the access to this Web page as the use that can be made of the information and contents included in the same or accessible from it, will be exclusive liability of whom performs this action, so MESEON will not be held liable for the responsibility of such uses.

Throughout MESEON it is possible to access to additional services, for this purpose it is necessary that a payment service had been previously subscribed by the user. In such cases, the user will have to read the special conditions that in each case will be specified in the web page of access to these additional services.

MESEON reserves the right to modify the legal conditions shown in this document without prior notice, being these ones applicable as soon as they are published.

MESEON will use all the possible means to keep the service up the 24 hours of the day, seven days a week and commits in case of failure, to carry out as soon as they are informed, the necessary repairs for the re-establishment of the service. However, if the failure in the service should be caused by other reasons and not by MESEON, such as prolonged interruption of any external supply, falls in the main nodes of the Network, social conflicts, third parties intervention, unforeseen circumstances such as the partial interruption of the service due to the need to update the equipments, MESEON will not ensure the re-establishment of the service in an effective way, being held free of liability for the damages that may be caused due to the interruption of the service.

Means of payment

MESEON offers services reachable through different means of payment detailed along the present page. To subscribe to these services, the user must insert the requested data.

By means of PayPal

Some services could be paid by means of the payment system PayPal; the data of the credit card will be directly transferred to the PayPal’s web page.

By means of bank transference

Likewise, MESEON makes available for the users determined services that can be paid by means of bank transference with specific instruction of the requested service. However, the order of performance of the service or of the sending of the request will not be given till the transference is received.
Those users that decide to use this payment system must consider that the expenses arising from the transference have to be paid by the buyer or hirer of the service.

Returns and Claims

The customer will have a period of 7 working days for any return of a piece or pieces of work, as of their delivery. For this purpose, the customer will have to contact MESEON by means of e-mail addressed to infomeseon.net, indicating the number of the invoice and the reason of the return. MESEON will contact the ARTIST or the GALLERY that sells the piece. MESEON will also contact the transport company to arrange the retirement of the product and the payment of the transport of the returned product.
In any way, the returns must fulfill the following requirements:

• The customer will have to pay all the transport expenses understanding as such, not only the ones of the service performed by the transport company, but also any other expense derived from the delivery, such as custom expenses or any other unexpected expense necessary for the return of the product. Such expense will be discounted to the customer when the return of the money is made.
• The product to be returned must be duly packed and in perfect condition. In this way, in case that any of both conditions are not fulfilled, the customer will have to pay the transport expenses and the money paid for the product will not be returned. All the previously mentioned, without prejudice of the actions that might correspond to the ARTIST in case that the integrity of his/her work would have been affected.

Use of the web page

The user commits to make adequate and licit use of the web site and of the Contents, according with the applicable legislation, the present General Conditions of Use, the ethics and good practices generally accepted and the public order, compelling to indemnify MESEON for any damage or injury that may be caused due to the web use, violating these general conditions and/or the current legality. The User must refrain from:

1. To lessen or harm the reputation and reputation of MESEON.
2. To make a non-authorized or deceitful use of the web page and/of their Contents with aims or unlawful effects.
3. To access or try to access to resources or restricted areas of the web page, not fulfilling the demanded conditions to such entrance.

Way to send the contents

When sending any type of content you guarantee that you are the author of the original piece or art or of any other content that you send or, in its case, that you are in possession of all the intellectual property rights or of any other nature necessary for the use projected in the web, being fully responsible in front of MESEON for the eventual claims that third parties may made upon results of contents for you supplied, included the lawyer and attorney fee though their intervention weren’t perceptive.
The ART COLLECTORS who wanth to publish the images of their collection on MESEON, guarantee that have the possession of all intellectual property rights needed for publish the artwork of a third party, being fully responsible in front of MESEON for the eventual claims that third parties may made upon results of contents for you supplied, included the lawyer and attorney fee though their intervention weren’t perceptive.
You should keep in mind that, according the current Intellectual Property Law, the ARTIST is the only responsible in deciding whether the publishing of his/her work will be made with his/her name or under pseudonyms.

Transference of rights

By sending the corresponding content you transfer to MESEON the exploitation rights necessary for the rendering of services so that the page can offer, show and sell such Content.

Liability

MESEON will not assume liability for the opinions, comments and published data, being liability of every author to verify the fulfillment of the current regulations regarding the Contents to be sent to MESEON and specifically to their respective Weblogs and Forums. MESEON does not assume therefore, any liability regarding the statements, reports, opinions or any other content provided by the users throughout their written comments, images or videos that have been published in the site. As a consequence, MESEON will not be considered liable of the accuracy, truthfulness, kindness, integrity, reliability or credibility of the provided information by the users; equally, MESEON can not be considered responsible of the mistakes, defamations, offenses, omissions or deceits transmitted or published by the users. Variations of prices

MESEON will not be held liable of the variations that may come up in the prices. Therefore, once a request has been made, a higher price than the one set at the moment of regularizing the purchase will be never applied.

MESEON will be able to retire or discontinue at any time and without need of prior notice the rendering of the Services to those users who don’t fulfill the established in the present Legal Advice and Use Conditions.

Applicable Legislation and Jurisdiction

The general conditions displayed in this document shall be governed by the Spanish law. The parties, with clear waiver to any other jurisdiction and provided that the normative of application allows it, are subdued to the competence and jurisdiction of the Courts and Tribunals of the city of Madrid, for the resolution of any argument or legal dispute that eventually can be submitted.
